In order to protect assets or wealth that an individual has coming into a marriage or may gain during the marriage, that person will want the parties to enter into a prenuptial (also referred to as an antenuptial) agreement. Understanding what courts look at in determining the validity of these agreements can assist you in drafting agreements to protect your client.
